Conveyance means Transfer

Full name of the service: Conveyance / Deemed Conveyance of Society.

Deemed Conveyance – In simple legal terminology, the deemed conveyance meaning can be explained as the transfer of right, title, and interest of the land or building in the name of the housing society.

Conveyance – the Promoters (cause for construction i.e. builder, landowner, or developer) willingly or voluntarily gives the conveyance.

  • As per the MOFA Act, It is the Builder’s liability to form the Society within 4 months from the date of the Occupation Certificate.
  • Then the Builder/Developer has to transfer the underneath land of the building along with the Building to the Society within 4 months from the date of the Formation of the Society by executing a Conveyance Deed in favour of the Society. 
  • If the builder complies with his obligation, it is called direct conveyance.
  • If a Builder fails to comply with his obligation, then the Government by stepping in the shoes of the defaulter Builders/Owners shall execute Conveyance on behalf of the Builder/landowners in favour of the Society is called Deemed Conveyance.
  • District Deputy Registrar of Cooperative Housing Societies has been empowered to give Deemed Conveyance in favour of the Society:
